The Russian legal market can be an unpredictable beast. A history of interfering politicians, corruption and debt crises, both internal and external, have meant that since the collapse of the Soviet Union, law firms in Moscow have struggled to maintain a steady grasp on just what might be around the corner. Despite all the variables, however, there is one constant, and that is the energy and natural resources sector, which dominates Russia’s foreign exports – in 2011 oil and gas revenues accounted for 10.4% of Russia’s GDP (up from 7.6% in 2009). Provided that commodity prices don’t drop for a sustained period of time – particularly crude oil, which has been strong since going above $50 a barrel in 2005 – a decent volume of work can be assured.

This was underlined in 2010, when the Russian state-owned oil producer Rosneft launched projects in the Kara and Barents Seas after obtaining licences to explore four blocks in Russia’s Arctic shelf. Three major joint ventures with the Western energy companies Exxon Mobil, Statoil and Eni were subsequently signed in 2011 and 2012. Continue reading “Russia: pipelines east”

Africa: into Africa

Recently it seems that not a week goes by without new clamour surrounding another legal market as law firms race to enter countries in Asia, Africa and Latin America. But of all the new frontiers that have been gaining favour with law firms, Africa’s focal points are the most difficult to pinpoint.

Australia’s immense popularity clearly leverages off its status as an English-speaking platform into key Asian markets, while the most popular hubs in Latin America are Brazil and Mexico – the two largest economies in the region. However Africa’s size and multiplicity of languages dictates that the continent has a plethora of regional springboards: UK firms are attracted to South Africa; Francophone firms have made Morocco their regional hub; while Lusophone players have rushed into Portuguese-speaking countries. Groundbreaking decisions continue to emerge from the Channel Islands courts. LB talks to key litigators involved in recent headline cases and assesses their wider impact

Two important judgments have emerged from Jersey and Guernsey this year. In April, in the case In the matter of the Shinorvic Trust (Shinorvic), the Royal Court of Jersey had to consider whether a longstanding principle of English law applies to trusts in Jersey; while in March, Guernsey’s Privy Council awarded the largest ever compensation payout in the UK in the Helmot case, a whopping £14m. This decision profoundly impacts on how damages for future losses in personal injury cases are calculated.

Offshore: Asia bound

Offshore law firms continue to launch offices in Asia, with Singapore and Shanghai the latest hot destinations. LB assesses the drivers behind recent openings and the challenges that lie ahead

The drive of offshore firms into Asia continues apace. Bedell Cristin opened a Singapore office in July, following Mourant Ozannes’ launch in Hong Kong at the start of the year; Appleby opened a representative Shanghai office in April; and in September, showing its own long-term commitment to South-East Asia, Maples and Calder also announced the opening of a Singapore office.

Offshore: Caribbean calling

UK offshore law firms are increasingly offering British Virgin Islands and Cayman Islands legal services from Caribbean offices or their Crown dependency bases. LB assesses the changing landscape of the Caribbean legal market

UK-based offshore law firms have been enjoying a Caribbean sojourn this year. In June Carey Olsen announced it would be opening an office in the Cayman Islands; Bedell Cristin established its British Virgin Islands (BVI) office at the start of 2012; while Mourant Ozannes launched in the BVI in September.

Malta – Island Haven

Despite the ongoing European crisis, Malta has proved to be one of the best performers in the eurozone. LB asks Malta’s leading firms what is so special about this Mediterranean island.

Although Malta has shown resilience during the global downturn, it has not been bypassed completely. M&A volume has reduced and the island’s banking sector is more cautious than ever about credit exposure. Nonetheless, Malta’s own slowdown has been relatively painless when compared to other European jurisdictions. The island is fiscally conservative and its level of state debt is fairly low, with most of it held locally. Consumer debt is also low.

Ireland – Court Appeal

Asked whether the Irish legal market is awash with contentious work, one leading litigator sighs deeply and quips: ‘Well, the country is certainly full of contention.’ Every dip in any economic cycle brings a raft of litigious work, but the spectacular collapse of Ireland’s banking and property sectors following the global credit crisis has brought unprecedented large-scale litigation, restructuring and administration (termed examinership in Ireland).

‘We are busier than we’ve ever been,’ confirms Liam Kennedy, head of dispute resolution at A&L Goodbody. ‘The first half of last year was all crisis litigation, but since then we’ve had a lot of big-ticket work, such as high-level restructuring, insolvency, regulatory and international asset tracing litigation.’ Continue reading “Ireland – Court Appeal”

Ireland – Céad míle fáilte

Shanghai’s location at the estuary of the Yangtze River attracts rainfall for a third of the year. Lawyers from the region will feel at home in Ireland then, a country not renowned for its weather. Earlier this year, law firm A&L Goodbody officially launched its pioneering Chinese Lawyer Exchange Programme, signing agreements with 15 Chinese law firms and universities, such as Beijing’s King & Wood Mallesons and Shanghai’s East China University of Political Science and Law. The programme will provide six-month placements at the firm’s Dublin office as well as in-house experience with clients such as Pfizer, Bank of Ireland and Telefónica O2. Such is the initiative that Irish Prime Minister Enda Kenny applauded the firm for its ‘enterprise’ and ‘courage’.

The purpose of the project is to promote inbound and outbound investment between the two countries. Foreign direct investment (FDI) into Ireland has long been a bright spot for the Irish economy, with headline multinationals such as Microsoft and Google choosing Ireland to base their European operations during the 1990s. Portugal – Getting Away

In response to a struggling domestic market, Portugal’s leading law firms are increasingly seeking opportunities in former Portuguese colonies. LB assesses the different international strategies being employed by the country’s top legal practices

Aside from a spate of short-term privatisation work (see ‘Going private’), Portugal’s transactional lawyers continue to bemoan the demise of their national M&A pipelines. In order to bolster growth, the country’s major law firms are venturing to Portuguese-speaking jurisdictions where the legal systems are similar and investment is flowing.

Portugal – Going Private

Despite its worst recession in decades, Portugal’s recent privatisation programme has sparked renewed investment interest. LB asks whether selling off the country’s prized assets can cure the woes of its legal market

With Portugal’s GDP expected to fall by 4.5% in 2012 and a series of hikes on VAT, corporate and individual income tax included in the 2012 Portuguese state budget, the country’s economy hardly appears inviting. Following its 2011 €78bn bailout (the Troika Memorandum) by the European Commission, the European Central Bank and the International Monetary Fund, Portugal has been forced to introduce a comprehensive privatisation programme that includes the energy and airports sectors, as well as the insurance and media industries.
